Terms and Conditions of Use



Article 1 (Purpose)

The purpose of these Terms and Conditions is to stipulate the rights, obligations, and responsibilities of the cyber mall and the user in using the Internet-related services (hereinafter referred to as the ‘Service’) provided by the cyber-mall (hereinafter referred to as the ‘Mall’) operated by Double U.L. Korea (e-transaction business).

Article 2 (Definition)

  • ‘Mall’ means a virtual place of business set up by Double U.L. Korea to provide goods or services to users using information and communication facilities such as computers to trade goods and services and is also used in the sense of a business operator operating a cyber-mall.
  • ‘User’ refers to members and non-members who access the ‘Mall’ and receive the services provided by the ‘Mall’ in accordance with these Terms and Conditions.
  • ‘Member’ refers to a person who has registered as a member by providing personal information to the ‘Mall’ and is continuously provided with information on the ‘Mall’ and can continue to use the services provided by the ‘Mall’.
  • ‘Non-member’ refers to a person who uses the services provided by the ‘Mall’ without registering as a member.

Article 3 (Statement, Explanation and Amendment of Terms and Conditions)

  • The ‘Mall’ shall post the contents of these Terms and Conditions, the name of the company and representative, the address of the business location (including the address of the place where consumer complaints can be handled), telephone number, fax number, e-mail address, business registration number, e-commerce business report number, and the person in charge of personal information protection on the initial service screen (front) of the cyber-mall so that users can easily understand the contents of these Terms and Conditions. However, the contents of the Terms and Conditions may be made available to the user through a connected screen.
  • The ‘Mall’ shall seek the user's confirmation by providing a separate connection screen or pop-up screen so that the user can understand important contents such as cancellation, delivery responsibility, refund conditions, etc. among the contents stipulated in the Terms and Conditions before the user agrees to the Terms and Conditions.
  • The ‘Mall’ may amend these Terms and Conditions to the extent that it does not violate the relevant laws such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Electronic Documents and Electronic Transactions Basic Act, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-door Sales, etc.
  • If the ‘Mall’ amends the Terms, it shall specify the date of application and the reason for the amendment and notify the current Terms on the initial screen of the ‘Mall’ from 7 days before the date of application to the day before the date of application. However, in the case of changing the contents of the Terms to the disadvantage of the user, a grace period of at least 30 days shall be given in advance. In this case, the ‘Mall’ shall clearly compare the contents before the revision and the contents after the revision and display them for easy understanding.
  • If the ‘Mall’ amends the Terms and Conditions, the amended Terms and Conditions shall apply only to contracts entered after the effective date, and the terms and conditions prior to the amendment shall apply to contracts already entered into prior to the effective date. However, if a user who has already concluded a contract transmits to the ‘Mall’ the intention to be subject to the provisions of the revised Terms and Conditions within the notice period of the revised Terms and Conditions pursuant to Paragraph 3 and receives the ‘Mall's consent, the provisions of the revised Terms and Conditions shall apply.
  • Matters not provided for in these Terms and the interpretation of these Terms shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, the Consumer Protection Guidelines for Electronic Commerce, etc. prescribed by the Fair-Trade Commission, and related laws and regulations or common practice.

Article 4 (Provision and Modification of Services)

  • The ‘Mall’ shall perform the following tasks
    • Provide information on goods or services and conclude a purchase contract
    • Delivery of goods or services for which a purchase contract has been concluded
    • Other tasks determined by the ‘Mall’
  • The ‘Mall’ may change the contents of the goods or services to be provided under a contract to be concluded in the future in the event that the goods or services are out of stock or the technical specifications are changed. In this case, the contents of the changed goods or services and the date of provision shall be immediately notified on the place where the contents of the current goods or services are posted.
  • If the ‘Mall’ changes the contents of the service contracted with the user to provide due to reasons such as out of stock of goods or changes in technical specifications, the ‘Mall’ shall immediately notify the user at the address where the user can be notified.
  • In the case of the preceding paragraph, the ‘Mall’ shall compensate the User for any damages incurred by the User. However, this shall not apply if the ‘Mall’ proves that it is not intentional or negligent.

Article 5 (Interruption of Service)

  • The ‘Mall’ may temporarily suspend the provision of the Service in the event of maintenance, inspection, replacement, or breakdown of information and communication facilities such as computers, or interruption of communication.
  • The ‘Mall’ shall compensate the User or a third party for any damages suffered by the User or a third party due to the temporary suspension of the provision of the Service due to the reason in Paragraph 1. However, this shall not apply if the ‘Mall’ proves that it is not intentional or negligent.
  • In the event that the Service cannot be provided due to the conversion of business items, abandonment of business, or integration between companies, the ‘Mall’ shall notify the user in the manner prescribed in Article 8 and compensate the consumer in accordance with the conditions originally proposed by the ‘Mall’. However, if the ‘Mall’ does not notify the compensation criteria, the ‘Mall’ shall pay the user's mileage or accumulated points in kind or cash equivalent to the value of the currency prevailing in the ‘Mall’.

Article 6 (Membership)

  • The User shall apply for membership by filling in the membership information in accordance with the registration form prescribed by the ‘Mall’ and expressing his/her agreement to these Terms.
  • The ‘Mall’ shall register a user who applies for membership as described in Paragraph 1 as a member unless the user falls under any of the following items.
    • If the applicant has previously lost membership pursuant to Article 7 (3) of these Terms and Conditions, except if the applicant has obtained the consent of the ‘Mall’ to rejoin membership after three years have elapsed since the loss of membership pursuant to Article 7 (3).
    • If there is any falsehood, omission or error in the registration contents
    • If it is judged that registration as a member is significantly hindered by the technology of the ‘Mall’.
  • The membership contract shall be concluded when the consent of the ‘Mall’ reaches the member.
  • The Member shall immediately notify the ‘Mall’ of any changes to the registration details pursuant to Article 15.1 by e-mail or other means.
  • If the Member withdraws from membership and rejoins, the Member must wait six months from the date of withdrawal before rejoining.

Article 7 (Withdrawal of Membership and Disqualification)

  • A member may request to withdraw from the ‘Mall’ at any time, and the ‘Mall’ shall immediately process the withdrawal.
  • If the Member falls under any of the following reasons, the ‘Mall’ may restrict or suspend the membership.
    • If the Member has registered false information when applying for membership
    • Failure to pay the price of goods or services purchased using the ‘Mall’ or other debts incurred by the member in connection with the use of the ‘Mall’ on the due date.
    • Threatening the order of electronic transactions by interfering with the use of the ‘Mall’ by others or stealing their information.
    • If you use the ‘Mall’ to commit acts prohibited by laws and these Terms and Conditions or contrary to public order and morals.
    • If you are a distributor, you violate the regulations set forth in the membership book provided by the Company.
  • After the ‘Mall’ restricts or suspends the membership, the ‘Mall’ may terminate the membership if the same act is repeated more than twice or if the reason is not corrected within 30 days.
  • If the ‘Mall’ disqualifies a member, the membership registration shall be cancelled. In this case, the member will be notified and given a certain period of time (30 days) to explain before the cancellation of membership registration.

Article 8 (Notices to Members)

  • If the Mall gives notice to a member, it may do so at the e-mail address that the Member has submitted to the mall.
  • In the case of notices to an unspecified number of Members, the Mall may substitute individual notices by posting them on the bulletin board of the Mall for more than one week. However, individual notices shall be given for matters that have a significant impact on the Member's transactions.

Article 9 (Purchase Application)

  • The user of the ‘Mall’ shall apply for purchase on the ‘Mall’ by the following or similar methods, and the ‘Mall’ shall provide each of the following contents in an easy-to-understand manner when the user applies for purchase.
    • Search and selection of goods, etc.
    • Input of the recipient's name, address, telephone number, e-mail address (or mobile phone number), etc.
    • Confirmation of the contents of the Terms and Conditions, the services for which the right of withdrawal is restricted, and the cost burden such as delivery charges and installation charges
    • Indication (e.g., mouse click) of acceptance of these Terms and Conditions and confirmation or refusal of items 3.1 above
    • Application for purchase of goods, etc. and confirmation of the same or consent to confirmation by the mall
    • Selection of payment method /li>
  • ‘If the ‘Mall’ needs to provide or entrust the personal information of the purchaser to a third party, the ‘Mall’ shall obtain the consent of the purchaser at the time of actual purchase application, and shall not obtain comprehensive consent in advance when registering for membership. At this time, the ‘Mall’ shall specify to the purchaser the items of personal information provided, the recipient, the purpose of the recipient's use of personal information, and the period of retention and use. However, if there are other provisions in the relevant laws and regulations, such as in the case of entrusting the handling of personal information pursuant to Article 25 (1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.

Article 10 (Formation of Contract)

  • The ‘Mall’ may not approve the purchase application as described in Article 9 if any of the following items apply. In addition, the ‘Mall’ does not allow minors (under the age of 19) to join, so if a minor (under the age of 19) joins, the membership is lost and the contract may be cancelled.
    • If there are any falsehoods, omissions or errors in the application contents
    • If the ‘Mall’ determines that accepting the purchase application is significantly impeded by the ‘Mall’ technology.
  • The contract shall be deemed to have been concluded when the ‘Mall's’ consent reaches the user in the form of a receipt confirmation notice pursuant to Article 12.1.
  • The ‘Mall’s acceptance shall include confirmation of the user's purchase application and information on availability, cancellation of correction of the purchase application, etc.

Article 11 (Payment Methods)

Payment for goods or services purchased from the ‘Mall’ may be made by any of the following methods. However, the ‘Mall’ shall not add any nominal fee to the price of the goods or services for the user's payment method.

  • Various account transfers such as phone banking, internet banking, mail banking, etc.
  • Various card payments such as prepaid cards, debit cards, credit cards, etc.
  • Online direct deposit
  • Payments by other electronic payment methods, etc.

Article 12 (Notification of receipt, change and cancellation of purchase application)

  • The ‘Mall’ shall send a receipt confirmation notice to the user when the user makes a purchase application.
  • If there is a discrepancy in the User's intention, the User may request to change or cancel the purchase application immediately after receiving the receipt of the receipt confirmation notice, and the ‘Mall’ shall process the request without delay if there is a request from the User before delivery. However, if the payment has already been made, the provisions of Article 15 shall apply.

Article 13 (Supply of Goods, etc.)

  • The ‘Mall’ shall take other necessary measures such as customisation, packaging, etc. so that the ‘Mall’ can deliver the Goods within 7 days from the date the User makes a request, unless there is a separate agreement with the User regarding the timing of the supply of the Goods. However, if the ‘Mall’ has already received all or part of the payment for the Goods, the ‘Mall’ shall take action within 3 business days from the date of receipt of all or part of the payment. At this time, the ‘Mall’ shall take appropriate measures to allow the user to check the procedure and progress of the supply of goods, etc.
  • The ‘Mall’ shall specify the means of delivery, the person who bears the delivery cost for each means, and the delivery period for each means for the goods purchased by the user. If the ‘Mall’ exceeds the agreed delivery period, the ‘Mall’ shall compensate the User for any damages caused by the ‘Mall’. However, this shall not apply if the ‘Mall’ proves that it is not intentionally or negligently negligent.

Article 14 (Refund)

If the ‘Mall’ is unable to deliver or provide the goods that the user has applied to purchase due to reasons such as being out of stock, the ‘Mall’ shall notify the user of the reason without delay, and if the user has received the payment for the goods in advance, the ‘Mall’ shall refund the payment within 3 business days from the date of receipt or take necessary measures to refund the payment.

Article 15 (Cancellation of Purchase, etc.)

  • Users who have concluded a contract with the ‘Mall’ for the purchase of goods, etc. may withdraw their subscription in accordance with the ‘Act on Door-to-Door Sales, etc.’ and the ‘Act on Consumer Protection in Electronic Commerce, etc.’. According to these laws, you have three months for members and 14 days for consumers to withdraw from the contract from the date of receipt of the written contract (if the supply of goods, etc. is later than the date of receipt of the written contract, the date on which the goods, etc. are supplied or the supply of goods, etc. begins).
  • If you have received the Goods, you may not return or exchange them in any of the following cases.
    • If the Goods are lost or damaged due to reasons responsible to the User (however, if the packaging, etc. is damaged in order to check the contents of the Goods, the User may withdraw the subscription.)
    • If the value of the Goods has decreased significantly due to the User's use or partial consumption of the Goods
    • If the value of the Goods has decreased significantly over time to the extent that resale is difficult.
    • When the packaging of the original Goods, etc. is damaged if it can be duplicated with Goods, etc. with the same performance.
    • In the case of a member, the member has excessive inventory of goods, etc. by falsely reporting to the multi-level distributor about inventory holdings, etc.
  • In the case of Paragraph 2 (2) to (4), the User's right to withdraw from the purchase shall not be restricted if the ‘Mall’ has not taken measures such as specifying the fact that the withdrawal of the purchase is restricted in advance in a place where the consumer can easily understand it or providing a trial product.
  • Notwithstanding the provisions of Paragraphs 1 and 2, if the contents of the Goods are different from the contents of the display or advertisement or are performed differently from the contract, the User may withdraw the Goods within three (3) months from the date of delivery and within thirty (30) days from the date the User knew or could have known the fact.

Article 16 (Effect of Cancellation of Purchase)

  • The ‘Mall’ shall refund the price of the goods, etc. already paid within 3 business days if the ‘Mall’ receives the goods, etc. from the user. In this case, if the ‘Mall’ delays in refunding the goods to the user, the ‘Mall’ shall pay the delayed interest calculated by multiplying the delayed interest rate stipulated in the ‘Act on Door-to-Door Sales’ and the ‘Enforcement Decree of the Act on Consumer Protection in Electronic Commerce’ for the delayed period.
  • In refunding the above payment, the ‘Mall’ shall request the business that provided the payment method to suspend or cancel the charge for the goods or services without delay if the user paid for the goods or services by a payment method such as credit card or electronic money.
  • The ‘Mall’ shall not charge any penalty or damages to the user for withdrawing the subscription, etc. However, if the contents of the goods, etc. are different from the contents of the display or advertisement, or if the user withdraws the subscription because the contract is performed differently, the ‘Mall’ shall bear the cost of returning the goods, etc.
  • If the user bears the shipping cost when the user receives the goods, the ‘Mall’ shall clearly indicate who bears the cost when the user withdraws the subscription so that the user can easily understand.

Article 17 (Personal Information Protection)

  • When collecting personal information of users, the ‘Mall’ collects the minimum amount of personal information to the extent necessary to provide services.
  • The ‘Mall’ does not collect information necessary for the fulfilment of the purchase contract in advance when registering for membership; however, this does not apply to the case where the minimum amount of specific personal information is collected in order to fulfil the obligations under the relevant laws and regulations, such as when identification is required prior to the purchase contract.
  • When the ‘Mall’ collects and uses the personal information of the user, the ‘Mall’ shall notify the user of the purpose and obtain the user's consent.
  • The ‘Mall’ shall not use the collected personal information for any purpose other than the purpose, and if a new purpose of use occurs or if it is provided to a third party, the ‘Mall’ shall notify the user of the purpose and obtain the user's consent at the stage of use and provision. However, exceptions shall be made if otherwise stipulated in the relevant laws and regulations.
  • If the ‘Mall’ is required to obtain the consent of the user pursuant to Paragraphs 3 and 4, the identity of the person in charge of personal information management (affiliation, name and phone number, other contact information), the purpose of collecting and using the information, and matters related to the provision of information to third parties (recipient, purpose of provision, and content of information to be provided) shall be specified or notified in advance, and the user may withdraw this consent at any time.
  • The User may request to view and correct errors in his/her personal information held by the ‘Mall’ at any time, and the ‘Mall’ shall be obliged to take necessary measures without delay. If the user requests the correction of an error, the ‘Mall’ shall not use the personal information until the error is corrected.
  • The ‘Mall’ shall limit the number of persons handling the User's personal information to a minimum to protect personal information and shall be liable for all damages caused by the loss, theft, leakage, provision to a third party without consent, falsification, etc. of the User's personal information, including credit card, bank account, etc.
  • The ‘Mall’ or a third party that has received personal information from the ‘Mall’ shall destroy the personal information without delay when the purpose of collecting or providing the personal information has been achieved.
  • • The ‘Mall’ does not set the consent box for the collection, use, and provision of personal information to be pre-selected. In addition, the ‘Mall’ specifically specifies the services that are restricted when the user refuses to consent to the collection, use, and provision of personal information, and does not restrict or refuse to provide services such as membership registration based on the user's refusal to consent to the collection, use, and provision of personal information that is not a mandatory collection item.

Article 18 (Obligations of the ‘Mall’)

  • The ‘Mall’ shall not engage in any acts prohibited by laws and these Terms and Conditions or contrary to public order and morals and shall do its best to provide goods and services continuously and stably in accordance with these Terms and Conditions.
  • The ‘Mall’ shall have a security system to protect the user's personal information (including credit information) so that the user can use the Internet service safely.
  • The ‘Mall’ shall be liable to compensate the user for any damages caused by the unfair display or advertisement of goods or services in accordance with Article 3 of the Act on Fairness of Display and Advertisement.
  • The ‘Mall’ shall not send commercial e-mails for commercial purposes that the user does not want.

Article 19 (Member's Obligations Regarding IDs and Passwords)

  • Except in the case of Article 17, the Member is responsible for the management of his/her ID and password.
  • The Member shall not allow any third party to use his/her ID and password.
  • If the Member realizes that his/her ID and password have been stolen or are being used by a third party, the Member shall immediately notify the Mall and follow the instructions of the mall.

Article 20 (Obligations of Users)

Users shall not engage in the following acts

  • Register false information when applying or making changes
  • Steal information of others
  • Alteration of information posted on the 'Mall'
  • Transmitting or posting information (computer programs, etc.) other than the information specified by the “Mall”
  • Infringement of intellectual property rights, including copyrights, of the “Mall” or other third parties
  • Acts that damage the reputation or interfere with the business of the “Mall” or other third parties
  • Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals on the Website
  • Failure to comply with laws and acts deemed inappropriate by the Mall.

Article 21 (Relationship between the connecting “Mall” and the subordinate “Mall”)

  • If a parent “mall” and a subordinate “mall” are connected by hyperlinks (e.g., the objects of hyperlinks include texts, pictures, and fairy tales), the former is called the connecting “mall” (website) and the latter is called the subordinate “mall” (website).
  • If the linking “mall” expressly states on its website that it is not responsible for the transaction with the user based on the goods and services independently provided by the linked “mall”, it shall not be responsible for the transaction.

Article 22 (Attribution of Copyrights and Restrictions on Use)

  • Copyrights and other intellectual property rights for works created by the 'Mall' shall belong to the 'Mall'.
  • The User shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes or cause a third party to use for commercial purposes any information obtained by using the 'Mall' in which intellectual property rights belong to the 'Mall' without the prior consent of the 'Mall'.
  • The 'Mall' shall notify the user if the copyright belonging to the user is used in accordance with the agreement.

Article 23 (Dispute Resolution)

  • The “Mall” shall establish and operate a damage compensation mechanism to reflect legitimate opinions or complaints raised by users and to compensate for the damage.
  • The “Mall” shall prioritize the handling of complaints and opinions submitted by users. However, if it is difficult to process promptly, the user shall be notified of the reason and the processing schedule immediately.
  • If a user applies for damage relief in connection with an e-commerce dispute between the “Mall” and the user, the dispute may be subject to mediation by the Fair Trade Commission or a dispute mediation organization commissioned by the city or provincial governor.

Article 24 (Jurisdiction and Governing Law)

  • Lawsuits regarding e-commerce disputes between the “Mall” and the user shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing, or if there is no address, the district court having jurisdiction over the user's residence. However, if the address or residence of the user is not clear at the time of filing, or if the user is a foreign resident, the lawsuit shall be filed in a court of competent jurisdiction under the Civil Procedure Act.
  • Korean law shall apply to e-commerce lawsuits between the mall and the User.

Addendum

These Terms are effective as of April 13, 2022. The Terms of Use currently in effect are hereby replaced by the new Terms of Use as of the revision date.
